WODUS platform and mobile apps (Android & iOS)
Products: WODUS / WODUS
Commercial name: AAAM Dev
Legal capacity: Natural person (persona natural) doing business as AAAM Dev / Maombi Lab, domiciled in the Bolivarian Republic of Venezuela
Platforms: Web (WODUS), Android (WODUS), iOS (WODUS)
Android package: com.aaamdev.boxwaveiOS: com.aaamdev.wodus
Effective Date: September 16, 2026
These Terms and Conditions ("Terms") are a binding electronic contract between you and the natural person who commercially operates as AAAM Dev and Maombi Lab ("Provider", "we", "us"). They govern access to and use of the WODUS website, the WODUS staff dashboard, and the WODUS mobile applications on Android and iOS, including any artificial-intelligence features (together, the "Services"). By downloading, installing, creating an account, clicking "I agree", or using the Services, you accept these Terms. If you do not agree, do not use the Services.
1. Acceptance and electronic contracting
These Terms are concluded electronically and have the same legal effect as a written contract under the Law on Data Messages and Electronic Signatures (Ley de Mensajes de Datos y Firmas Electrónicas, Official Gazette No. 37.148 of 10 February 2001), the Civil Code of Venezuela, and, where the user acts as a merchant, the Commercial Code.
Downloading WODUS from Google Play or the Apple App Store, creating a WODUS account, ticking a consent box, or continuing to use the Services after notice of these Terms constitutes a data message expressing consent. You are responsible for keeping a copy of these Terms. We may keep electronic logs of acceptance as evidence.
2. Who provides the Services (protection of the natural person)
The Provider is a natural person (persona natural) engaged in lawful commercial activity from the Bolivarian Republic of Venezuela. AAAM Dev, Maombi Lab, and WODUS are commercial names, product names, and brands. They do not create a corporation, partnership, joint venture, or other limited-liability legal entity, and they do not make any family member, housemate, employee, contractor, or collaborator a party to this contract.
To protect the Provider's private life, honor, and personal security (Constitution of the Bolivarian Republic of Venezuela, Articles 20, 46, 55, and 60):
- The contracting party is solely the natural person acting in the commercial activity of the Services, identified by the names AAAM Dev / Maombi Lab.
- Valid legal notices, claims, and service of process related to the Services may be sent only to contact@getwodus.com. Notices sent to a home address, personal social-media profile, unofficial phone number, family member, or unrelated workplace are invalid and may be treated as harassment.
- You will not publish, request, or circulate the Provider's civil name beyond what is strictly necessary for a lawful claim, national identity number, home address, images of family members, or other personal data unrelated to the Services.
- Gyms, coaches, athletes, Apple, Google, hosting providers, payment processors, and internet or electricity carriers are independent third parties. Their acts are not acts of the Provider.
- Nothing in this section lets the Provider evade liability for willful misconduct (dolo) or gross negligence (culpa grave) where Venezuelan law forbids that exclusion, nor rights that constitutional or consumer law makes non-waivable. It does allocate risk, set the exclusive notice channel, and limit who may be treated as a defendant to the maximum extent the law allows.
3. Definitions
In these Terms:
- "WODUS" means the web software for gym and studio operators (scheduling, attendance, billing tools, and related dashboards) and the athlete-facing mobile application published on Google Play and the Apple App Store (Android package com.aaamdev.boxwave).
- "Athlete app" means the WODUS mobile application used by gym members (Android package com.aaamdev.boxwave).
- "Gym" or "box" means the independent fitness business that subscribes to WODUS and invites athletes to the WODUS mobile app.
- "Operator" means a gym owner, staff member, or coach using WODUS.
- "Athlete" means an end user of the WODUS mobile app who belongs to a gym.
- "You" means the person or business accepting these Terms (Operator, Athlete, or website visitor).
- "AI Features" means any feature that uses machine learning, large language models, recommendation systems, automated text or workout suggestions, or similar statistical systems.
4. The Services
The Services are software tools for class booking, attendance, workouts (WODs), personal records, membership administration, and related gym operations. They are provided as a technology platform only. The Provider does not operate gyms, does not coach, does not provide medical, nutritional, or sports-performance services, and is not a party to the membership contract between a gym and an athlete.
Features may differ between Web, Android, and iOS, and may change as we develop the product. We do not promise that every feature will exist on every platform or remain available forever.
5. Eligibility and minors
You must have legal capacity to contract under the Civil Code. If you accept these Terms for a gym, you represent that you have authority to bind that business.
WODUS is not directed to children. In line with the Organic Law for the Protection of Children and Adolescents (LOPNNA), Google Play Families policies, and Apple's Kids Category / age-rating rules:
- You must be at least 13 years old to create an Athlete account, and at least 18 years old to create an Operator (gym) account or to purchase a paid WODUS plan.
- If you are between 13 and 17, you may use WODUS only with the consent and supervision of a parent, guardian, or the gym that lawfully holds that consent.
- We do not knowingly collect personal data from children under 13. If we learn that we have, we will delete it.
- Gyms are solely responsible for verifying that their members meet age and medical-clearance rules applicable to high-intensity training.
6. Accounts and security
You must provide accurate information and keep credentials confidential. You are responsible for activity under your account. Notify us promptly at contact@getwodus.com of unauthorized access.
We may suspend or terminate accounts that are inaccurate, abusive, insecure, or in breach of these Terms, or when required by Apple, Google, a gym, or applicable law. Account deletion is described on the Account Deletion page and in the Privacy Policy.
7. License to use the apps
Subject to these Terms, the Provider grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use WODUS on devices that you own or control, and to access WODUS through a supported browser, solely for the internal purposes of your gym membership or gym operations.
You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or circumvent technical protections of the Services except to the extent a non-waivable law (including interoperability rules) expressly allows it. All rights not granted are reserved.
8. Apple App Store (iOS) — Licensed Application terms
If you obtain WODUS from the Apple App Store, the following minimum terms required for a custom End User License Agreement apply, in addition to the rest of these Terms. In this section, "Licensed Application" means the iOS version of the WODUS athlete app.
- These Terms are between you and the Provider only, not Apple Inc. or its subsidiaries ("Apple"). Apple is not responsible for the Licensed Application or its content.
- The license is a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions. The Licensed Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing as allowed by Apple.
- Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Licensed Application. The Provider is solely responsible for support. Support requests go to contact@getwodus.com or the Support page.
- To the maximum extent permitted by law, Apple has no warranty obligation whatsoever with respect to the Licensed Application. If the Licensed Application fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the applicable App Store purchase price (if you paid Apple any such price). To the maximum extent permitted by law, Apple will have no other warranty obligation.
- The Provider, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of it, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar laws.
- In the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, the Provider, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim to the extent required by these Terms.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms of agreement when using the Licensed Application (for example, your wireless-data agreement).
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they relate to the Licensed Application. Upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
- If these Terms conflict with Apple's App Store Review Guidelines or the Apple Developer Program License Agreement on a mandatory point, the Apple requirement controls solely for distribution on the App Store, and only to the minimum extent necessary.
9. Google Play (Android) terms
If you obtain WODUS from Google Play, distribution is also subject to the Google Play Developer Distribution Agreement and the Google Play Terms of Service. Google LLC and its affiliates are not parties to these Terms and have no obligation to provide maintenance, support, or warranties for WODUS.
- The Provider, not Google, is solely responsible for WODUS, its content, support, and any claims relating to the app, including product liability, legal compliance, consumer protection, and intellectual-property claims.
- Gym membership fees, drop-in fees, and similar amounts paid to your gym are charged by your gym, not by Google and not as a Google Play in-app purchase, unless a specific product listing expressly says otherwise.
- If we ever sell digital goods or subscriptions through Google Play, we will use Google Play Billing as required by Google policy. WODUS gym-operator subscriptions billed on the web are processed outside Google Play.
- Uninstalling WODUS from an Android device does not by itself delete your account or gym records. Use the Account Deletion page or in-app deletion to request erasure.
- You must comply with Google Play's user policies and applicable third-party terms (including your carrier agreement).
- If these Terms conflict with a mandatory Google Play policy for Play distribution, the Google policy controls solely for that distribution, and only to the minimum extent necessary.
10. Gyms, athletes, and independent operators
Each gym is an independent business. The Provider does not employ gym staff, does not control coaching methodology, equipment, or premises, and does not guarantee that a gym will honor a class, membership, refund, or safety standard.
Athletes contract with their gym for training. Disputes about class quality, injuries, membership freezes, refunds of gym fees, or coach conduct must be directed to the gym. The Provider may, at its discretion, provide technical logs to the gym or to a competent authority when legally required.
11. Fees, payments, currency, and tax
Paid WODUS plans (currently Starter, Growth, and Pro) are charged to gym operators according to the pricing shown at the time of purchase. Prices may be stated in United States dollars (USD) or another reference currency. Multi-currency displays (including REF, USD, and VES) are operational tools for gyms; displayed conversions (including any BCV-related rate) are informational and not a promise of a particular exchange rate, availability of foreign currency, or result at SENIAT or a commercial bank.
Unless a written invoice says otherwise, fees are exclusive of taxes. The Provider will issue tax documentation required by the Organic Tax Code and SENIAT rules for the commercial activity. You are responsible for your own tax obligations.
Proof-of-payment uploads by athletes are sent to the gym for the gym to review. The Provider does not hold athlete membership money as an escrow agent and is not a payment institution, bank, or casa de cambio.
Refunds and cancellations of amounts paid to the Provider follow the Return and Refund Policy at /returns (14-day window for WODUS paid plans, original payment method, no physical returns because the product is digital). Apple App Store and Google Play refunds follow those stores’ rules. Chargebacks made in bad faith are a breach of these Terms.
12. User content
You retain ownership of content you submit (profile data, payment proofs, WOD results, community posts, comments). You grant the Provider and your gym a worldwide, non-exclusive, royalty-free license to host, process, display, and transmit that content only to operate the Services.
You represent that you have the rights to submit the content and that it does not infringe others' rights or the law. We may remove content that appears unlawful, dangerous, or in breach of these Terms, including when Apple, Google, or a gym reports it.
13. Acceptable use and computer-related offenses
You must not misuse the Services. Without limitation, you must not do anything that would constitute an offense under the Special Law against Computer Crimes (Ley Especial contra Delitos Informáticos, Official Gazette No. 37.313 of 30 October 2001) or successor rules, including unauthorized access, sabotage of systems, fraud by informatic means, or unlawful appropriation or disclosure of personal data.
You also agree not to:
- Probe, scan, or overload the Services; introduce malware; or bypass authentication or payment controls.
- Scrape, harvest, or resell other people's personal data.
- Impersonate the Provider, a gym, a coach, or another athlete.
- Use the Services to send spam or unlawful marketing, or to process payments you are not authorized to process.
- Upload sexual content involving minors, or any content that exploits children or adolescents (absolutely prohibited).
- Use AI Features to generate illegal, defamatory, or deceptive content, or to attempt to obtain professional medical, legal, or financial advice presented as coming from a licensed professional.
14. Artificial intelligence
The Services may include AI Features (for example, suggested workout copy, summaries, reminders, insights, or automated classifications). Venezuela does not yet have a fully enacted general Artificial Intelligence Act. A bill was approved in first discussion by the National Assembly (2024) and remains in process. The Ministry of Science and Technology (MINCYT) published a Code of Ethics for the Responsible Development and Application of Artificial Intelligence (February 2026). We design AI Features in light of that ethics code (human-centered use, fairness, privacy, transparency, and accountability), the Constitution, the computer-crimes law, and any AI statute that later enters into force.
You acknowledge and agree that:
- AI outputs are probabilistic. They may be incomplete, outdated, biased, or wrong (including invented facts). They are not medical, nutritional, legal, accounting, or coaching professional advice, and they are not a substitute for a qualified coach or physician.
- You must review AI outputs before relying on them. Gyms remain responsible for WODs, scaling, and athlete safety even if software suggested text or structure.
- AI Features are not intended to produce legal or similarly significant effects about a person solely by automated means. Material decisions (blocking a member, charging a fee, deleting an account) remain subject to human review by the gym or the Provider as applicable.
- We do not sell your personal data to third parties so they can train general-purpose AI models. We may use de-identified or aggregated technical data to operate and improve the Services, as described in the Privacy Policy.
- You will not use AI Features to identify a person from data you are not allowed to use, to generate sexual content of minors, or to circumvent these Terms.
- To the maximum extent permitted by law, the Provider is not liable for losses caused by reliance on AI outputs, model downtime, or changes made by third-party model providers.
- If a Venezuelan AI law, the MINCYT ethics code as later made binding, or a foreign rule that legally applies to us (for example, for users in the European Union) requires additional notices, consent, or risk controls, we may modify or disable AI Features to comply.
15. Health, fitness, and sports-risk disclaimer
High-intensity functional training, CrossFit®-style workouts, weightlifting, and similar activities involve inherent risk of injury, illness, rhabdomyolysis, cardiovascular events, and, in extreme cases, death. The Services may display workouts, loads, PRs, or leaderboards. That display is not a prescription, medical clearance, or personal training session.
You participate in training at your own risk and under your gym's responsibility. You should consult a physician before starting or changing an exercise program, especially if you have any medical condition. The Provider is not liable for injuries or health outcomes that occur at a gym, outdoors, or anywhere else in connection with a workout shown in the Services, except for dolo or culpa grave that Venezuelan law does not allow us to exclude.
16. Personal data
Processing of personal data is described in the Privacy Policy, which forms part of these Terms. In Venezuela, protection of personal data is a constitutional right (Articles 28 and 60 of the Constitution; honor, private life, intimacy, confidentiality, and habeas data). Additional rules appear in the Special Law against Computer Crimes and, for public-sector systems, the Infogobierno Law. A comprehensive Personal Data Protection Law has been discussed by the National Assembly; if it is published in the Official Gazette and applies to us, we will comply and may update the Privacy Policy.
Gyms are independent controllers of their member databases. Athletes should also read their gym's rules. You may request access, correction, or deletion as described in the Privacy Policy and the Account Deletion page.
17. Consumer and user rights
If you qualify as a consumer or user under Article 117 of the Constitution and the laws that develop it (including the Organic Law of Fair Prices and the powers of SUNDDE, and any successor consumer statute), mandatory rights granted by those laws are not waived by these Terms. Where a consumer law requires a specific warranty, information duty, or complaint path, that law prevails over a conflicting sentence in these Terms, only to the extent of the conflict.
For Operators who contract as merchants in the course of their gym business, the relationship is commercial and the protective consumer regime may not apply to the same extent. Nothing here is an offer to waive rights that cannot be waived.
18. Intellectual property
The Provider and its licensors own the software, design, logos, and documentation of WODUS. CrossFit® is a registered trademark of CrossFit, LLC. WODUS is not affiliated with, endorsed by, or sponsored by CrossFit, LLC. Other marks belong to their owners. Details are in the Copyright Notice.
19. Disclaimers of warranty
To the maximum extent permitted by Venezuelan law, the Services are provided "as is" and "as available". The Provider does not warrant uninterrupted or error-free operation, that defects will be corrected, that the Services will meet your gym's particular objectives, or that AI Features will be accurate.
Internet, electricity, banking, app-store, and cloud-hosting failures are outside the Provider's reasonable control. Implied warranties are excluded except those that the law does not allow to be excluded.
20. Limitation of liability (protection of the natural person)
This section is a central risk allocation. You acknowledge that the Provider is a natural person, that subscription fees are modest relative to the risks of operating a gym and of physical training, and that the Services would not be offered on the same terms without these limits.
To the maximum extent permitted by the Civil Code and other applicable law:
- The Provider is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, goodwill, or business opportunity; gym refunds owed by a gym to an athlete; injuries or health events; or failures of Apple, Google, hosting, email, WhatsApp, banks, or public utilities.
- The Provider's total aggregate liability arising out of or related to the Services is capped at the fees you actually paid to the Provider (not to your gym) for the Services during the twelve (12) months before the claim. If you paid the Provider nothing (typical for Athletes using WODUS through a gym), the cap is USD 100 (one hundred United States dollars) or the equivalent in VES at the official rate on the claim date, whichever mechanism a competent court applies.
- These limits apply to contract, extra-contractual liability, and any other theory, and to the Provider's heirs, successors, contractors, and collaborators to the extent claims are aimed at them because of the Services.
- Liability for dolo or culpa grave cannot be excluded where the Civil Code or consumer law forbids it. In that case, every remaining limitation still applies to the fullest extent allowed, and recoverable damages are limited to the direct, proven damage caused by that dolo or culpa grave.
- You must send a written notice describing the issue to contact@getwodus.com and allow thirty (30) calendar days to cure before filing a lawsuit or administrative complaint, except where a non-waivable law sets a different procedure or a shorter statute of limitations makes that wait impossible.
21. Indemnity
You will defend, indemnify, and hold harmless the Provider, and the Provider's heirs, contractors, and collaborators, from claims, damages, and reasonable legal costs arising from: (a) your use of the Services; (b) your gym's operations, coaching, billing of athletes, or premises; (c) your content; (d) your breach of these Terms or of law; or (e) your use of AI outputs. This indemnity protects the natural person who provides the Services and does not require any family member to become a party.
22. Force majeure and fortuitous event
The Provider is not responsible for delay or failure caused by events beyond reasonable control, including those treated as caso fortuito or fuerza mayor under the Civil Code. Examples include blackouts, internet or backbone failure, app-store outages or policy changes, cloud-provider outages, war, civil disturbance, epidemics, currency or payment-system restrictions, official exchange-rate changes, acts of public authority, and natural disasters. Obligations resume when the event ends, as reasonably practicable. Recurring subscription periods affected by a long interruption may be handled in good faith on a case-by-case basis; this is not a guarantee of credits.
23. Term, suspension, and termination
These Terms apply from the moment you accept them until your account is closed. You may stop using the Services at any time. Operators may cancel a paid plan according to the order or invoice terms then in force. We may suspend or terminate access immediately if you breach these Terms, if a gym asks us to disable an athlete, if Apple or Google require it, or if the law requires it.
Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, health disclaimer, AI disclaimer, governing law, and protection of the natural person) survive termination.
24. Changes
We may update these Terms. The new version will be posted on this page with a new effective date. For material changes, we will give additional notice where reasonable (for example, in-app or by email). Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Services and, if you have a paid plan, cancel according to your order terms.
25. Governing law and disputes
These Terms are governed by the laws of the Bolivarian Republic of Venezuela, without regard to conflict-of-law rules that would point to another country.
Unless a non-waivable consumer rule gives you a different forum, exclusive jurisdiction lies with the courts of the Judicial Circumscription of the Metropolitan Area of Caracas, Venezuela. You and the Provider waive any other venue to the maximum extent permitted. Proceedings shall be conducted in Spanish. An English version is provided for convenience and for Apple and Google distribution; if there is a conflict, the Spanish version controls for facts and users connected with Venezuela, and the English version may be used to interpret Apple- or Google-required clauses.
Nothing prevents either party from seeking urgent injunctive relief to protect personal data, intellectual property, or personal safety.
26. Miscellaneous and contact
If a clause is held invalid, the rest remains in force and the invalid clause will be modified to the minimum extent needed to make it valid. These Terms are the entire agreement for the Services and supersede prior terms of use, except that the Privacy Policy, Copyright Notice, and any signed order or invoice for a paid WODUS plan remain in force. You may not assign these Terms without our consent; the Provider may assign them to a company or other person that continues the Services. Failure to enforce a clause is not a waiver.
Questions about these Terms: contact@getwodus.com. Support channels are listed on the Support page. Do not use personal or family channels for legal or support notices.
